Successions

If a Portuguese citizen passes away in Brazil, it is important to initiate the probate process in Brazilian courts if the deceased left assets in the country.

Article 89 of the Brazilian Code of Civil Procedure expressly provides for the exclusive jurisdiction of Brazilian authorities to handle probates and asset distribution in Brazil, even if the decedent was a foreigner who resided outside Brazil.

According to the Introductory Law of the Civil Code, Article 12: "The Brazilian judicial authority is competent when the defendant is domiciled in Brazil or when the obligation must be fulfilled in Brazil."

In cases where the deceased left assets in both Brazil and Portugal, two probate processes must be initiated—one in Portugal and another in Brazil—to ensure the comprehensive succession of the deceased's estate

Therefore, we advise that citizens residing abroad and Portuguese descendants who have inheritance rights in Portugal regularize their civil registrations, thus avoiding future complications.
