Portugal eases rules for entry of Brazilians; understand

Visas will be granted by the consulate, with no need for prior analysis by the Foreigners and Borders Service (SEF)

Obtaining authorization to enter Portugal will become easier for Brazilians. The Council of Ministers of Portugal approved this Thursday, the 1st, an agreement that relaxes the requirements for procedures and documentation for the entry, stay and exit of Brazilians and those from other Portuguese-speaking countries. The changes will come into effect on September 25th.

According to the statement from the Portuguese organization, “the approved changes promote mobility and freedom of movement within the Community of Portuguese-Speaking Countries”. The other members of this network are Angola, Brazil, Cape Verde, Guinea-Bissau, Equatorial Guinea, Mozambique, São Tomé and Príncipe and East Timor.

With the changes, the granting of short-term visas, temporary stay visas or residence visas for citizens of Portuguese-speaking countries will no longer need to be previously analyzed by the Foreigners and Borders Service (SEF). The release will be done by the consulate.

Lawyers interviewed by Estadão reported that more details about the simplification of required documentation, forms for visa applications and deadlines are yet to be provided by the Portuguese consular representations in Brazil. The report attempted to contact the Consulate General of Portugal in São Paulo and the Vice-Consulate of Portugal in Curitiba on Friday, but had not received a response by 6 pm.

Brazilian citizens do not need a visa to enter Portugal for tourism, business, journalistic coverage and cultural missions, as long as it is for a period of 90 days. This period can be extended in Portugal with authorization from the SEF, and the extension cannot exceed 90 days. A visa is required for Brazilian citizens in any other situation.

Under the rules in force until now, even for visa exemption cases there were some requirements, such as presentation of a passport with a minimum validity of at least 3 months longer than the duration of the intended stay, a round-trip airline ticket, proof of accommodation, employment or professional activity in Brazil (declaration issued by the employer, public or private) and financial resources to finance the stay, equivalent to €75 for each entry into national territory, plus €40 for each day of stay.

“These new rules allow citizens of a Member State to obtain a preliminary and immediate visa grant, by simplifying and waiving several requirements and analysis procedures. However, it is important to make it clear that it is necessary to meet the requirements, no matter how small they may be,” says lawyer Alexandre Thiago Hennies, from Hofstaetter Tramujas e Castelo Branco Advogados Associados.

Workforce

The relaxation of rules for Portuguese-speaking countries is a response to the growing need for labor in Portugal and an attempt to revitalize the national economy. The European country has been implementing a series of changes to its migration rules. In July, changes to the Foreigners Law (Law 23/2007) also made it easier to enter and remain in the country.

“The new regime seeks to make things easier for those seeking work, study and housing opportunities in Portugal. This is especially important for Brazilians, given the current economic and social situation. For workers, there will certainly be facilities, especially for those who work in areas with more opportunities in Portugal,” says the lawyer.

A new visa has been created specifically for people who want to look for work in Portugal. It lasts for 120 days, which can be extended for another 60 days. Those who obtain a work contract are granted the right to apply for a residence permit in the country. Those who do not find a job must return to their country of origin, but can try again by obtaining the same type of visa after a period of one year.

Temporary stay and residence visas may also be granted to digital nomads, professionals who work remotely.

Student visa

The granting of a visa to higher education students also no longer requires approval from the SEF, which used to take about two months, in cases where the applicant has been approved by an educational institution.

All that is required is proof of enrollment. The residence permit granted to higher education students is valid for two years and can be renewed for the same period of time.

Visas for family members

People accompanying family members who already have temporary stay or residence visas will also be allowed to enter Portugal.

When the residence visa for family reunification and family reunification is issued, tax, social security and national health service identification numbers will be automatically assigned.
